Terms and Conditions
Please read the following terms carefully. By checking the box, "I have read and accept these conditions" during checkout, you are confirming that you agree to be bound by these terms.
For the purposes of this contract, any person who purchases a subscription, pack, or class from Convo Class in order to receive classes online will hereinafter be referred to as ´student.´
The facilitators of these online classes acting on behalf of Convo Class can be referred to as ´teacher´ or ´Convo Class´ indistinctly throughout this agreement. Convo Class is a registered company in Spain created by Chelsea Riley, whose NIE is Y5719457S.
This document serves as a description of the services to be provided and the legal requirements corresponding to the student and/or Convo Class, as agreed upon by both parties.
1. DEFINITION OF CLASSES
The classes are 50 minutes long. If the student arrives late, the teacher is in no way obligated to stay longer to complete the full 50 minutes. If the student hasn’t arrived within the first 20 minutes of class time, the teacher has the option to close the class and regard the class as a no-show.
For the purposes of this agreement, a course is defined as all classes taken by the student, starting from the first class until the student completes or cancels his or her subscription or package of classes. The course material may be subject to change based on the expressed needs and goals of the student. Class topics can be focused on conversational English, professional English, exam preparation, rectification of grammar and pronunciation errors, as well as expansion of vocabulary. Convo Class is in no way responsible for any exam scores, grades, or the performance of students in any class or examination.
After each class is completed, the student will be provided with the materials used in class as well as feedback on their performance. If the student is not provided this information within 48 hours of the completion of the class, the student is to contact the teacher or Convo Class directly in order to facilitate the relevant documents. Missing feedback or material in no way entitles the student to a reimbursement for the class.
There are no prerequisites required to take this course.
The length of the course itself is dependent on the plan or pack the student chooses. Detailed information about the cost, number of classes included and time allotted to complete the course is outlined in charts 1 and 2 below.
The classes are designed for anyone age 4 and up. Minors are at all times to be under the care of a parent or guardian and the teacher is not responsible for his or her behavior. If during a video call the teacher perceives that someone is in danger, the teacher is urged to make this known to the competent authorities.
While the student has a course active, regardless if it is a subscription or a pack of classes, they will also have access to a weekly group class called Weekly Chat. The attendance of this class is subject to availability as there are a limited number of participants for each class. This class is free of charge for all current students.
2. DETAILED SPECIFICATIONS OF ALL SUBSCRIPTIONS AND CLASS PACKS
All information regarding the number of classes and costs each month, the number of classes and costs in total, and course duration is outlined in the charts below:


3. PAYMENTS
Payments are to be made by credit or debit card or Apple Pay through www.convoclass.com. Convo Class does not accept any payments in person, by cash, or by check.
The monthly plans are recurring payments that will be made once a month on the date of purchase. These plans will automatically renew every month until the plan is cancelled by the student. These payments will be made via direct debit from the account that the student made available for this purpose. Once the plan is cancelled, the following month on the renewal date the student will not be charged.
The 3-month plans have recurring monthly payments that will automatically stop after 3 months have elapsed.
The 6-month plans have recurring monthly payments that will automatically stop after 6 months have elapsed.
The school year plans have recurring monthly payments that will automatically stop after 10 months have elapsed.
The individual classes and class packs are a one-time payment and therefore will not recur.
Educational services are tax free in Spain in accordance current legislation on value added tax (Artículo 20.Uno.9.º de la LIVA). The student will not be charged any taxes for the plans or packs purchased.
4. ENROLLMENT AND SCHEDULING CLASSES
Enrollment:
Upon purchasing a class, subscription, or class pack, the student will be asked to book their first class in the online booking system provided at www.convoclass.com. The student will then have their own client login for the site. In this way they can make reserve or cancel classes and check their account information.
Reserving a class:
The course will start on the day specified by the student in their booking. Class bookings can be done through our online booking system or directly with the teacher and are subject to teacher availability. All lessons must be paid in full and in advance, with the exception of the free trial class. Bookings can be made up to 50 days in advance.
Short notice classes:
Classes should be scheduled 24 hours or more before the class’ start time. You may contact the teacher directly to see if they have short notice availability, however the teacher is in no way obligated to accept short notice classes.
5. CANCELING CLASSES
Student cancelations:
It is always free to cancel or reschedule a class as long as notice is given more than 24 hours in advance. You can cancel or reschedule a class via call or text at +34684014725 or by email at info@convoclass.com.
For any cancelations within 24 hours of the class’ start time, each plan and pack has an allowance of ´hall passes´, or late cancelations without penalty. In order to use a hall pass, the teacher must be notified of the cancelation before the class start time. The number of hall passes allowed depends on the plan or pack purchased and is outlined in Table 3 below:

A class will be non-refundable if:
-
No notice is given and the student is absent from the class.
-
The student connects to the class, but is unable to be connected for the full 50 minutes.
-
All hall passes corresponding to the student's plan have been used, and the student cancels or reschedules the class less than 24 hours before the class' start time.
-
The student has not completed all the classes within the time period designated by their plan or applied for an extension in order to use all the classes.
Teacher cancelations:
If for some reason the teacher must cancel a class and gives notice 24 hours in advance, the student will be notified via text, call or email and the class will be rescheduled.
If the teacher cancels the class less that 24 hours before the class start time, the student will not lose the class. It will be rescheduled for a date that the teacher and student decide on. Additionally, the student will be awarded a voucher for an additional class for free.
If the teacher is absent from class, the student will not lose the class, and the student will receive a voucher for a free class. The student should get in contact with the teacher or Convo Class as soon as possible so the situation may be rectified.
6. CANCELING SUBSCRIPTIONS
There are options available to cancel the subscriptions if the student finds themselves unable to continue the classes. Each plan has its own procedure and consequences as outlined below:
The monthly subscription plans (including 1x, 2x and 3x week) are able to be canceled at any time, free of charge. The cancelation will take effect starting the next purchase cycle, which occurs every month on the same date as the start date. The student would be able to continue using the classes from that purchase cycle until the day before the account would have renewed. The subscription may be reactivated by the student online or by contacting Convo Class.
EXAMPLE: Teresa started her 1x week monthly subscription on April 17th, and every month her account renews on the 17th. If she decides to cancel on February 29th, she will still have access to classes until the last day of the purchase cycle, ending on March 16th. She would not be charged on March 17th for the following month's classes, thus terminating her subscription. She would not have to pay any cancelation fee to cancel her subscription.
If the student has not taken any classes and wishes to be reimbursed for their plan, the student must make a claim within 14 days of the date of purchase in order to be reimbursed in full, only paying the relevant transaction fees. If the student has begun using the service by taking at least one class (trial class included), the student forfeits their right to full reimbursement. If the student wishes to cancel their subscription from that point on, the cancelation would be made effective the following purchase cycle and not include any cancelation fee.
The 3-month, 6-month, and school year plans are offered at a discounted rate and thus will incur a 50 € cancelation fee if the student wishes to cancel the subscription before the time period has elapsed. This cancelation fee is to cover any chargeback costs as well as compensate the teacher for such changes in scheduling.
EXAMPLE: David bought a 6-month plan and started taking classes on September 20th. After 3 months of taking the classes, David became very busy at work and couldn't continue taking classes. He decided to cancel his plan on December 13th, a week before the 4th monthly payment. David would have to pay a 50€ cancelation fee, but would not have to continue making payments.
If the student has not taken any classes and wishes to be reimbursed for their plan, the student must make a claim within 14 days of the date of purchase in order to be reimbursed in full, only paying the relevant transaction fees. If the student has begun using the service by taking at least one class (trial class included), the student forfeits their right to full reimbursement. If the student wishes to cancel their subscription from that point on, the cancelation would be made effective the following purchase cycle and include a 50€ cancelation fee.

7. CLASS PACKS AND REIMBURSEMENT FOR UNUSED CLASSES
Class packs, regardless of the number of classes purchased, are also offered at a discounted rate and thus cannot be fully reimbursed after the student has started the program by taking their very first class (trial class not included). This includes all of the class packs listed in Table 6 below. There is no cancelation fee, however the student will only be reimbursed 13€ for each of the remaining classes. Additionally, the student will be responsible for paying any transaction fees or chargeback costs incurred. The student has the option to extend their course duration by means of written request.
EXAMPLE: Clara bought the pack of 50 classes for 860€. After 26 classes (one trial class + 25 classes from the pack), she decided to cancel the remaining 25 classes. Clara would be reimbursed 325€, minus the relevant transaction fees.
If the student has not taken any classes and wishes to be reimbursed for their plan, the student must make a claim within 14 days of the date of purchase in order to be reimbursed in full, only paying the relevant transaction fees. If the student has begun using the service by taking at least one class (trial class not included), the student forfeits their right to full reimbursement. Thereinafter, the student would only be entitled to a reimbursement of 13€ for each remaining class, from which transaction fees would be subtracted.

8. REFUNDS
Any type of refund or reimbursement would be made to none other than the original buyer.
There will be no refunds for classes that have been taken, be it in part or in full, nor for classes that the student did not attend and did not give notice more than 24 hours’ notice to either the teacher or Convo Class.
Refunds will be processed as soon as possible, however a 30-day period is to be allowed so that the refund may be organized and processed adequately.
In the event that Convo Class cancels the subscription or remaining classes of a student, the student would be reimbursed in full for all remaining classes or for the monthly payments. No cancelation fee would be applied, and Convo Class would be responsible for paying any transaction fees incurred.
9. TECHNICAL REQUIREMENTS
All classes will take place via a video conferencing platform, such as Google Meet or Zoom. In order to connect to the classes, you will need to have access to the following:

Software – The class may be accessed online in a browser or via desktop app for the relevant program.

Internet speed - A stable internet connection is needed in order to have class without interruptions. You can test your internet speed at https://www.speedtest.net/. The recommended speed for video conferencing is a download speed of 1.5 to 2 Mbps and an upload speed of 2 Mbps.

Phone, tablet or computer – The classes often include presentations, videos, and interactive activities, so using a tablet or computer is recommended. This is not a requirement, you can attend class on your phone, however it may affect the productivity of the class.

Camera and microphone - Typically, the camera and microphone that the average device is equipped with has sufficient quality to have class.

Settings and permissions – the student will have to approve the use of the microphone and camera in the browser used to access the class (Chrome, Safari, Edge, etc.)
Also, using headphones in the class is highly recommended, as it greatly helps with accurate pronunciation.
10.TECHNICAL PROBLEMS
It is the responsibility of the student ensure the proper functioning of their microphone, camera, internet connection, etc. before starting the lesson. However, if there are extenuating circumstances or connectivity issues that prevent the student from attending the class, contact the teacher or Convo Class via email or text so that the lesson might be rescheduled or tech support can be provided.
Convo Class teachers offer basic tech support for day-to-day connectivity problems, so don’t hesitate to contact either your teacher or Convo Class to solve any technical issues.
11. INTELLECTUAL PROPERTY RIGHTS
Convo Class produces materials for student personal use. All such materials are marked with the Convo Class logo. Any distribution or commercial use of the materials provided is strictly prohibited, as they are considered to be the property of Convo Class.
Videos or online activities used in class but not directly produced by Convo Class are excluded from the intellectual property of Convo Class.
12. JURISDICTION
Any disputes arising from or relating to this agreement shall be resolved in accordance with the laws of Spain.
Parties agree to attempt to resolve any disputes through negotiation or mediation before pursuing legal action.
13. DATA PROTECTION
The student's personal data will be processed in compliance with all Spanish laws regarding the protection of personal data and freedoms of digital rights (Ley Orgánica 3/2018, de 5 de diciembre, de Protección de Datos Personales y garantía de los derechos digitales). The student consents to the collection, processing, and storage of the personal data they have made available exclusively for course-related purposes.
Convo Class agrees to adopt the means necessary to safeguard the student’s data. The student is able to withdraw their consent to the processing of their data at any time by written notice. Convo Class is responsible for the permanent deletion of the personal data in its entirety, in compliance with the relevant legislation.
